Damage Caps on Private Torts in New Mexico
When it comes to private torts (i.e. you file a claim against a person or private business) in New Mexico, there is no damage cap or maximum liability. This holds true for both compensatory and punitive damages.
Damage Caps for Claims Against Government Entities in New Mexico
If a government entity person acting on behalf of a government entity is negligent, leading to your injury, there are different rules. According to NM Stat § 41-4-19 (2024), “in any action for damages against a governmental entity or a public employee while acting within the scope of the employee’s duties as provided in the Tort Claims Act,” the damage cap is set at $300,000 for medical expenses, past and future, and $400,000 for other compensatory damages, and cannot exceed $750,000 combined.
Medical Malpractice Damage Caps in New Mexico
The New Mexico Medical Malpractice Act NM Stat § 41-5-6 (2024) is designed to update damage caps for medical malpractice cases in New Mexico every year, based on inflation. This means the medical malpractice damage cap for your injury will be different based on the date you sustained the injury.
The following damage caps are based on compensatory damages that do not include past and future medical care or benefits related to past and future medical care, and they are strictly caps for negligence of healthcare providers, not hospitals.
- If the injury or death occurred before January 1st, 2022, the cap is $600,000.
- If the injury or death occurred between January 1st, 2022, and January 1st, 2023, the cap is $750,000.
- If the injury or death occurred in the 2024 calendar year, the cap is $1,000,000.
- If the injury or death occurred in the 2025 calendar year, the cap will be calculated based on the average consumer price index for the last three years.
This list also does not include punitive damage caps for medical malpractice in New Mexico.
Additionally, should the hospital or hospital-controlled outpatient care facility be found liable, the damage caps for injury or death, not including past and future medical care needed as a result of the injury, or punitive damages are also calculated by the year the injury or death occurred. The years and caps for finding New Mexico hospitals or hospital-controlled facilities are as follows:
- 2022: $4,000,000
- 2023: $4,500,000
- 2024: $5,000,000
- 2025: $5,500,000
Again, these numbers do not include punitive damages.
Are There Caps on Punitive Damages in New Mexico?
There are no caps on punitive damages in New Mexico; however, it can be difficult to prove malice in certain cases that would constitute punitive damages.
Punitive damage caps are subject to change, and in many states, there are hard caps on punitive damages, especially in cases of medical malpractice.
Most recently, a Republican bill was put to the Senate in January of 2025, pushing for damage caps on punitive damages in New Mexico. Although the bill didn’t pass, it is important to note that tort reform like this can be a constant battle.
