ALERT: Car Accident Lawyers in Albuquerque Recover $400,000 for Couple in T-Bone Wreck
The Ron Bell Injury Lawyers legal team was able to secure a combined $400,000 settlement for a couple in Santa Fe, NM after a negligent driver ran a red light and t-boned them on the passenger side of their vehicle. This is their story.
For the sake of confidentiality, we are going to refer to the husband in the wreck as Mister and the wife as Mrs.
WHAT HAPPENED TO THE AUTO ACCIDENT VICTIMS?
On one afternoon in the middle of summer 2022, our clients were traveling north through Albuquerque, NM. They were driving through an intersection of which they had a greenlight, meaning they had the right of way, when they were suddenly struck by a reckless driver who ran a red light. As our clients did not see the other driver coming, they were unable to avoid the collision and took the entire force of the incident on the front passenger side of the vehicle.
Mister was driving and Mrs. was in the passenger seat. Upon police arrival, both of our clients were able to speak and explicitly tell the officers what had happened, in addition to what they were feeling. Both explained they were t-boned by a driver that had ran a redlight, Mister was having trouble breathing, and Mrs. was pretty sure her leg was broken. They were both transported to the hospital by ambulance for further evaluation.
WHAT INJURIES WERE SUSTAINED IN THE T-BONE ACCIDENT?
Upon arrival at the hospital, both clients were taken through diagnostics and testing to understand just how injured they were.
Due to the car wreck, Mister was severely injured and was diagnosed with or experiencing the following:
- Fractures to three of his right ribs
- Manubrial fracture (a bone in the chest, right above the sternum)
- Costochondral fracture
- Immense bruising and cuts
- Pain in his right knee, lower back, and hip
- Hearing loss
- Balance issues
Also caused by the wreck, Mrs. experienced chest, knee, hip, and back pain, as well as weakness in her left leg. She was diagnosed with a manubrial fracture and a nondisplaced right L1/L2 transverse process fracture (spinal injury). Further, like her husband, she had many cuts and bruising from the incident.
WHEN DID THEY CONTACT CAR ACCIDENT ATTORNEYS IN NEW MEXICO?
Mister and Mrs. sustained injuries in their wreck and called Ron Bell Lawyers of Albuquerque, New Mexico.
The incident occurred on July 22nd, 2022. By July 24th, Mister and Mrs. called us to see how we could help, and we brought them both on as clients and got to work.
WHAT DID THE CAR ACCIDENT LAWYERS AT RON BELL DO?
Our team began by investigating the claim:
- Acquiring the police report related to the incident.
- Gathering the medical records and bills each client had incurred from the wreck.
- Talking with the clients to understand their side of the story.
- Working to get each client the medical treatment they needed to heal from the incident.
After investigation, our team knew the next steps we needed to take. Typically, there are two insurance companies we communicate with when negotiating a settlement – the insurance for the at-fault vehicle involved and our client’s insurance company. However, our team discovered during our investigation that the defendant was driving a rental car when the incident occurred, and that there was additional coverage we could file a claim against. Finally, we were able to obtain the client’s dash cam footage which clearly showed the Defendant running the red light.
Our experienced personal injury attorneys then sent a demand letter to the insurance companies – both to the defendant’s personal insurance and the coverage purchased through the rental company – to work toward obtaining the compensation they deserved and needed for their injuries.
Typically, a demand letter includes the following:
- A short introduction stating who we are, who we are representing, and what the claim number associated is.
- A quick summary of what we are demanding and why we are demanding it.
- A deadline for response (most demands are timed, and the insurance company must respond by a certain date for the letter to be upheld).
- The amount of medical bills + other expenses our client incurred from the incident.
- All the evidence to show what the client went through, including:
- Police report
- Medical records
- Medical bills
- Other expenses
- Photos, videos, etc.
Mister experienced severe injuries from the wreck and endured vast medical treatment due to his injuries. His demand letter included over 500 pages of evidence gathered, reviewed by our team, and attached for reference for the insurance companies. Additionally, we sent demand letters of a similar stature to the same insurance companies to ensure Mrs. received compensation she deserved for her injuries.
WHAT WAS THE RESULT OF THIS CAR ACCIDENT CASE?
With all of the evidence presented, the defendant’s personal insurance company tendered a policy limits offer of $250,000 to Mister for his injuries. Further, the rental car company’s insurance company also offered policy limits of $25,000. In total, Mister was set to receive $275,000 of compensation for his injuries, which would more than cover the expenses he had endured due to the incident. We advised him of the offer, and he accepted.
Our other client, Mrs., received similar treatment from the insurance companies and was offered $100,000 from the defendant’s personal insurance company and $25,000 from the rental car company’s insurance company. Although she had gone through the same incident, her injuries were not as severe. Therefore, the $125,000 offer was substantially more than enough to cover the medical bills and expenses she had incurred, so she accepted.
