How Did the Side-Swipe Accident Occur?
On November 5, 2021, Randy was driving southbound on NM 528. Traffic in the lane he was in was moving slower than other lanes so Randy decided to switch lanes, while obeying all traffic laws. As he was passing, a driver in the middle lane decided to abruptly switch lanes, without noticing Randy was right beside her. As she entered Randy’s lane, she side-swiped his car on the passenger’s side. When the side impact occurred, Randy’s vehicle swerved right into a third vehicle that was waiting in traffic in the center lane, right in front of the driver that struck Randy.
All three vehicles involved in the accident were moderately damaged and were towed from the scene.
What Injuries Did Randy Sustain in the Car Accident?
Although Randy didn’t report any injuries at the time of the accident, he did sustain severe injuries that ended up reducing his quality of life. Since many accident victims experience shock or an increased release of adrenaline after an accident, injuries can be difficult to notice immediately after an incident occurs.
This is exactly what Randy experienced. However, the morning after the car accident, Randy quickly realized something was wrong, as the adrenaline had finally worn off.
He began experiencing lower back pain as well as tingling and numbness. He headed to Urgent Care where they gave him X-rays. When they found no broken bones, they sent Randy to the emergency room to get a CT scan. Randy was given an injection for the pain he was feeling and an injection for the inflammation found. However, the hospital failed to provide an MRI, and missed the fact that Randy had actually suffered two undiagnosed supraspinatus full thickness tears of his right and left shoulders.
In the days that followed, Randy was diagnosed with paresthesia, syncope, and dizziness.
How Did the Ron Bell Team Help?
When Randy contacted Ron Bell, our intake team listened to his story and took detailed notes on his statement, learning exactly what took place in the incident. After the intake team took Randy’s information, the case was evaluated and accepted.
Our experienced injury attorneys started collecting evidence, include the police report and medical records.
As they reviewed the evidence, our attorneys found that the policy limit for the at fault party was only $25,000, and Randy’s damages, were much higher than that.
Randy had purchased underinsured motorist coverages but under New Mexico law, they get an offset or “credit” for what the Defendant pays. This reduced his coverage by $25,000, an amount he needed due to the extent of his injuries.
After reviewing the policy documents from his insurance however, the attorneys at Ron Bell realized that the insurance had failed to follow the law and inform him of this offset. As such, they drafted a demand letter explaining that Randy was not properly informed on how his policy would limit him from getting the recovery he needed in the event of an accident. The attorneys argued that this failure required them to waive their offset and provide him with the full $100,000 in coverages he purchased.
The insurance company conceded and we were able to secure a $125,000 settlement for Randy’s losses.
